Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Gossipp website, products, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
The Services are offered by Gossipp in connection with the sale and promotion of Gossipp iced tea and related products. References to “we,” “us,” and “our” mean the applicable Gossipp entity operating the storefront you use.
2. Eligibility
You must be at least the age of majority in your place of residence to place orders. If you use the Services on behalf of a business, you represent that you have authority to bind that business.
3. Products, pricing, and availability
We strive to display accurate descriptions, images, and prices. However, occasional errors may occur. We reserve the right to correct errors, update information, limit quantities, refuse or cancel orders (including after an order is submitted), and change or discontinue products without prior notice, except where prohibited by law. If we cancel an order after payment, we will refund the charged amount according to our refund practices.
4. Orders and payment
When you place an order, you offer to purchase the items in your cart at the prices shown, plus applicable taxes and shipping. We accept orders only when we confirm shipment or otherwise accept the order. You agree to provide current, complete, and accurate purchase and account information. Payment is processed by our third-party payment providers; their terms may also apply.
5. Shipping and risk of loss
Shipping options, carriers, and timelines are described at checkout or on our site and may change. Title and risk of loss pass to you upon delivery to the carrier, unless applicable law requires otherwise. We are not responsible for delays caused by carriers, weather, customs, or events outside our reasonable control.
6. Returns and refunds
Return eligibility, time limits, and refund methods depend on product type and policy in effect at the time of purchase. Please review the return policy posted on our site or contact customer service for assistance. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
7. Promotions and subscriptions
Promotional codes, discounts, and subscription or auto-delivery programs are subject to additional terms disclosed at signup or checkout. We may modify or end promotions in accordance with those terms.
8. Acceptable use
You agree not to:
- Use the Services unlawfully or in a way that harms others or our systems;
- Attempt to gain unauthorized access to our networks, accounts, or data;
- Scrape, harvest, or misuse data except as allowed by law or with our written consent;
- Interfere with security features or impose an unreasonable load on our infrastructure; or

You may not copy, modify, distribute, or create derivative works without our prior written permission, except for limited personal, non-commercial use as reasonably necessary to shop with us.

The Services may link to third-party sites or integrate third-party tools (e.g., payment, analytics, reviews). We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; IN THOSE JURISDICTIONS, DISCLAIMERS ARE LIMITED TO THE EXTENT PERMITTED BY LAW.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER GOSSIPP NOR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.
13. Indemnity
You will defend, indemnify, and hold harmless Gossipp and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Services, or violation of law or third-party rights, except to the extent caused by our willful misconduct.
14. Dispute resolution
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless mandatory consumer protection laws of your jurisdiction require otherwise. You and we agree that the state and federal courts located in Delaware shall have exclusive jurisdiction over disputes, subject to any non-waivable rights you have to bring claims in your home courts under applicable consumer law.
15. Changes
We may modify these Terms at any time by posting an updated version on this page and updating the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.
16. General
If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and us regarding the Services and supersede prior agreements on the subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
